Customer Declarations:

You declare that

  • You are over the age of 18.
  • You are one of the registered owners of the property at the installation address, and your name is on the title deed of the installation address.
  • Crown Solar is the trading name of Urban Environmental Revolutions Australia Pty Ltd. ABN34 612 046 885. All solar-related activities are registered under Crown Solar. 

1. Payments and STCs

    • You must have the final payment before or on the day of the installation by cash, check, or electronic fund transfer (EFT). The transaction must be completed within 48 hours from the installation day, and you must provide us with written proof of the transfer. Suppose you are one of the financially approved customers. In that case, you have to authorise the finance company to pay Crown Solar on the same day upon completion of the installation. 
    • For bank transfer or direct deposit, please pay at Crown Solar. BSB: 062 692. Account number: 7592 9523
    • You agree to pay Crown Solar the STC (Small Scale Technology Certificate) and/or PDRS (State Government’s rebate for battery installation by IPART) as part payment for your system. The STCs and/or PDRS will be directly paid to Crown Solar. Suppose the office of the Clean Energy Regulator or IPART determines you are not eligible to receive STCs and/or PDRS. Therefore, Crown Solar is unable to receive STCs and PDRS as part of the payment. In that case, you will be liable to pay Crown Solar the value of STCs and/or PDRS at the market rate.
    • This quote includes the NSW Battery Rebate under the Peak Demand Reduction Scheme (PDRS). Eligibility criteria apply and must be confirmed prior to installation. If the customer is ineligible, rebate value will be added back to the final price
    • If you are not eligible for STCs and PDRS or if you wish to claim STC or PDRS incentives yourself, the complete payment (including the trading cost of STCs/PDRS) of the system is due before installation.
    • You acknowledge that if you breach any conditions of the STC incentive regulations, you may be financially liable to the Office of the Clean Energy Regulator.
    • Crown Solar will arrange for the complete documentation and processing of the sales of STCs and PDRS. You acknowledge that the price of STCs and PDRS is governed by the market. If the market price falls below a certain level, Crown Solar may decide to delay installation until the price rises to a higher level, or you may ask for your deposit back.
    • If you fail to pay any amount that is due and payable under the agreement, Crown Solar will be entitled to charge interest on the unpaid amount at the current Reserve Bank target rate plus 2%. You will also have to pay Crown Solar any costs associated with the recovery of such an unpaid amount.
    • Title and ownership of the solar system will be bestowed upon Crown Solar receiving complete payment from you for the cost of the solar system.
    • Failure to pay the complete amount may result in Crown Solar taking legal action against you, and it will void all the warranties.

 

2. Authority of access to property

    • You authorize Crown Solar and its contractors, employees, and installer’s full access to the property at all reasonable times to carry out all work associated with the installation of your solar system, including site inspection, the signing of required paperwork, the delivery and installation, and connection to the grid. 

 

3. Liabilities and Risk

    • The ownership and insurance risk of the SolarPV system are passed to you upon installation, and Crown Solar will receive full payment for the system. It is your responsibility to ensure that your property insurance adequately covers the cost of your SolarPV system.
    • You acknowledge that Crown Solar accepts no responsibility for any damage that the installers have not caused during the time of installation. However, if the damage happens because of the installer’s negligence, Crown Solar will work with you to rectify the damage caused to your property or the system. Crown Solar carries appropriate insurance for third-party property damage and all subcontractors. Crown Solar also carries similar insurance for any unfortunate event.
    • Crown Solar will take all necessary precautions to complete the system installation without any damage to the roof or property. Crown Solar will inform the customer of any broken or brittle roofing during installation. However, Crown Solar will not be responsible for any damage caused to old tiles, brittle roofing, or structural damage after installation.
    • Crown Solar accepts no responsibility for any additional costs associated with upgrading the meter board or any other non-compliant materials by the respective electrical authorities. Crown Solar does not install or configure a meter for the solar feed-in tariff. However, we will help the customer to organise the meter change/configuration by their respective retailer, or we may apply to the retailer on the customer’s behalf.

 

4. Delivery and Installation

    • Crown Solar will make every reasonable effort to install the system promptly. The general lead time for installation by Crown Solar is 3-4 weeks from the date of this agreement until a particular date has been set. However, due to unforced circumstances, if we cannot do the installation by the due date, we will make a re-arrangement with the customer at the earliest. 
    • Crown Solar will engage SAA (Solar Accreditation Australia) accredited installers only to install the system. Crown Solar also assures that all of the team members working under the solar project have appropriate training, safety gear, authority, insurance, and a direct line of supervision from the licensed electrician assigned to the job.
    • Homeowner/owners or their authorised representative must be present during the installation to sign the mandatory declaration to assign the STCs to Crown Solar. Upon completion of the job, the installer will run down with the customer how to operate their newly installed solar system and all the safety procedures.

 

5. Network approval and meter installation

  • Crown Solar will take all the necessary approvals from the respective network provider before installing the SolarPV system, unless the customer obtains the approval, in which case Crown Solar is happy to support the customer in every step at no charge for the system below 30kW. However, for systems above 30kW, Crown Solar will charge the customer for preparing documentation and consulting at an agreed rate (non-refundable) if the customer wishes to apply for network approval themselves but seeks assistance from Crown Solar. If the customer is required to take any prior approval from their strata, body corporate, local council, or any other authority besides the network provider, they need to organise themselves. Crown Solar will help the customer with supplying documentation if it is related to solar products, installation, or insurance.
  • Upon installing solar, Crown Solar will supply a compliance certificate to the customer along with other necessary documentation and information on how to organise the meter change/reconfigure. Customers need to contact their respective electricity retailer to organise the net meter reconfiguration or other necessary changes. However, upon request from the customer, Crown Solar can apply for the meter change on behalf of the customer. It is highly recommended to contact the electricity retailer if no action is taken by the retailer within 4 weeks of the solar installation, and Crown Solar can also help customers to follow up with the retailer.

 

6. Privacy Policy

    • You agree to provide Crown Solar with whatever personal information is required for the efficient functioning of Crown Solar on your behalf, in particular for the accurate completion of paperwork for the STC incentive and network connection to the grid.
    • Crown Solar will provide your information to its installers, contractors, employees, and relevant authorities only as required to perform their jobs.
    • Unless otherwise discussed with you, Crown Solar will not supply your information to any third parties other than those mentioned above.

 

7. Product and performance warranties

    • Crown Solar reserves the right to change the standard system configuration due to technological advancement, installers’ diligence, or availability. At Crown Solar, our motto is to provide better products or the latest products in case we cannot supply the original materials that the customer has signed for. However, if there is a difference in cost due to any changes, Crown Solar will seek the customer’s approval before commencing any work. Only upon approval from the customer, Crown Solar will carry out the job.
    • Crown Solar will be liable for supplying goods as mentioned in the system details section and installation services. Crown Solar also guarantees that all the materials that will be used for the job are compliant and approved by the Clean Energy Council (CEC) or relevant authority and as per the norms for a grid-connected/off grid solar PV system in Australia.
    • All goods and services are subject to standard manufacturer’s warranty; the agreement excludes all other guarantees and warranties. However, if the manufacturer warranty conflict with consumer guarantees under the Australian Consumer Law in that case Australian Consumer Law will prevail.   
    • Crown Solar will use its best endeavours to maximize the system’s performance by adopting an efficient system design. However, system efficiency may vary for many reasons, like roof orientation, roof angle, shade profile on the roof, multiple strings, long cable run, distance from the switch board to the inverter, insufficient capacity consumer main or service main cable, etc. However, Crown Solar will not be liable for system loss or performance loss due to those reasons mentioned above or other natural occurrences, or the customer’s fault or lack of maintenance of the system. Crown Solar does not provide any warranty for monitoring. However, Crown Solar will provide customers with an expected performance of the system with their current circumstances. 

 

8. Cooling Off Period 

    • Customer has 10 10-business-day cooling-off period. During which the customer may cancel this agreement with written or email notification to Crown Solar. Upon cancelling the contract, the customer will receive a full refund of the deposit if given to Crown Solar. However, once the cooling-off period has elapsed, the deposit amounts or part of them will be perforated and will be used to cover administrative, material, logistics, application fee/charges, or any other cost associated with the particular job.

 

9. Termination of Contract

Crown Solar may terminate this contract with the customer if either of the following occurs: 

    • The customer has not abided by the terms and conditions.
    • There are delays in the Crown Solar process causing supplier prices to increase, in which case a full deposit will be refunded.
    • Crown Solar has the authority to cancel the installation if it is deemed to be dangerous or there is a risk of damage to either party. Crown Solar will refund the deposit paid by the customer.
    • Customers can terminate the contract and receive a full refund of the deposit if there is a significant change in the design, products, or prices from the initial contract and the customer is not willing to accept the change.
    • Customers are entitled to terminate the contract and receive a full refund of the deposit if Crown Solar fails to deliver the project within the time frame specified in the contract, unless the circumstances are outside the control of Crown Solar, such as force majeure, technological shifts, or delays from the network authority (in which case we will be in full communication with the customer and keep them updated and seek additional time).

 

10. Customer’s rights and responsibilities

  • Customers have the right to receive clear and accurate information about the products, pricing, energy savings, and contracts.
  • Customers have the right to get the products and services they have signed for. If Crown Solar failed to fulfill the contractual agreement, then customers have the right to terminate the contract and get a full refund.
  • Customers have the right to ask for/obtain an installer’s license and appropriate documentation to carry out the installation.
  • Customers are entitled to quality installations that meet the industry standard and are also bound by the New Energy Tech Consumer Code (NETCC).
  • Customers have the right to get the installation and warranty documents upon completion of jobs if there is no other obligation holding them to obtain them.
  • The customer’s right under this agreement is in addition to the consumer guarantees under the Australian Consumer Law and that these are not excluded or replaced by this contract or agreement in any shape or form.
  • Customers must adhere to the agreed payment terms for installation and financing.
  • Customers are responsible for maintaining their solar systems as described in their warranty booklet or manufacturer booklet and ensuring they are in good working condition.
  • Customers are responsible for monitoring their system performance and reporting any issues to Crown Solar/Installer at the earliest.
  • Customers are responsible for negotiating for a solar buyback with their respective retailer or finding the right retailers for a good buyback rate/consumption rate.
  • Customers may/need to inform their insurance company as a part of their home and content insurance to include solar for any unforced circumstances where product warranty won’t cover the damage (like natural disaster, hail damage, debris, physical damage, etc).

 

11. Warranty Claim

    • Crown Solar is endeavouring to assist customers with all their warranty claims within the warranty period.
    • Customers are to contact Crown Solar if they experience performance issues, mechanical or electrical damage, or malfunctioning of the system at their earliest with some evidence like photos, details notes, etc.
    • Upon receiving the evidence from the customers and diagnosing the issue, if it is deemed to be any reason other than reasons mentioned in the manufacturer warranty guideline or installation warranty guideline, then Crown Solar will discuss with the customer appropriate solutions or the cost may involve to fix the matter. If it is one of the reasons that is covered under the manufacturer warranty or installation warranty, then Crown Solar will help the customer launch the warranty claim.
    • Crown Solar will work with customers and manufacturers to get the matter sorted at the earliest. However, Crown Solar does not guarantee the manufacturer’s time-frame nor have any control over them in this regard.
    • Crown Solar provides a 10-year workmanship warranty for the job. Within this warranty period, Crown Solar is responsible for any installation-related issue. However, Crown Solar is not responsible for the manufacturer’s hardware replacement until unless mentioned in the contract.
